END USER LICENSE AGREEMENT (EULA)

For “Woo EU Right of Withdrawal Button”

IMPORTANT – READ CAREFULLY: This End User License Agreement (“Agreement”) is a legal agreement between you (either an individual or a single legal entity) and WhiteTip Code (“Licensor”) for the “Woo EU Right of Withdrawal Button” WordPress/WooCommerce plugin, which includes computer software and may include associated media, printed materials, and “online” or electronic documentation (collectively, the “Software”).

By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Software.

1. GRANT OF LICENSE

Subject to the terms and conditions of this Agreement and your payment of the applicable license fee, WhiteTip Code grants you a limited, non-exclusive, non-transferable license to install and use the Software on the number of WordPress websites (domains) permitted by the specific license tier you purchased.

2. UPDATES AND SUPPORT

The purchase of a license grants you access to automatic Software updates and premium technical support for a period of exactly 12 months (1 year) from the date of purchase, unless your subscription is renewed.

Updates: Updates may include bug fixes, security patches, compatibility updates, and new features.
Support: Technical support covers installation issues and bug reports. It does not cover custom development, server configuration, or third-party plugin conflicts.
License Validation: The Software periodically communicates with the WhiteTip Code License Server (whitetipcode.com) to verify license validity, registered domains, and available updates.

3. NO LEGAL ADVICE & DISCLAIMER OF COMPLIANCE

CRITICAL DISCLAIMER: The Software is designed to assist e-commerce merchants in providing a mechanism for consumers to exercise their right of withdrawal in accordance with European Union consumer protection laws (specifically Art. 54-bis).

However, WhiteTip Code is not a law firm and does not provide legal advice. The Software is provided “as is,” and while designed to meet specific technical requirements of EU regulations, the Licensor makes no warranty or guarantee that the use of the Software ensures 100% legal compliance for your specific business, jurisdiction, or legal obligations.

You (the merchant) are solely responsible for ensuring that your terms and conditions, privacy policies, withdrawal procedures, and overall business practices comply with all applicable local, national, and international laws. WhiteTip Code shall not be held liable for any legal audits, fines, penalties, or disputes arising between you and your customers or regulatory authorities.

4. OWNERSHIP AND INTELLECTUAL PROPERTY

You may not claim intellectual or exclusive ownership of any of our products, modified or unmodified. The Software, including all code, graphics, and documentation, is the property of WhiteTip Code. You may not distribute, sub-license, rent, or sell the Software or your license key to any third party.

5. DISCLAIMER OF WARRANTIES

THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no event shall WhiteTip Code be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, loss of data, or any other pecuniary loss) arising out of the use of or inability to use the Software, even if WhiteTip Code has been advised of the possibility of such damages. In any case, WhiteTip Code’s entire liability under any provision of this Agreement shall be limited to the amount actually paid by you for the Software license.

7. TERMINATION

Without prejudice to any other rights, WhiteTip Code may terminate this Agreement if you fail to comply with its terms and conditions. In such event, your license key will be revoked, and you must destroy all copies of the Software in your possession.

8. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions. Any legal action or proceeding arising under this Agreement will be brought exclusively in the courts located in Italy, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.
